The NJ Department of Transportation's regulatory authority over passenger carrying vehicles is limited to transportation "for hire" and does not include transportation of passengers without payment. Seapointe Recreation operated a bus to transport the residents of Seapointe Village, a private community, to other locations in Wildwood and Wildwood Crest, NJ and did not charge the passengers a fare. The objections raised by a local bus company alleging "destructive competition" were denied.
